Liability Release For Participation in Event

In exchange for participation in Bachata Sensual classes, workshops, teams, and events (the “Activity”), organized by: Bachata Sensual Orlando LLC and/or Anastasia Nikolaeva & Jovanny Fuentes [Name] located at Rhythm & Smooth Event Venue and/or other venues where the Activity may be hosted [Address] (“Releasee”),

 

I hereby agree as follows:

 

1. I and anyone claiming on my behalf release and forever discharge Releasee and its affiliates, successors and assigns, officers, employees, representatives, partners, agents and anyone claiming through them (collectively, the “Released Parties”), in their individual and/or corporate capacities from causes of action of any nature and kind, known or unknown, which I may have against Releasee or any Released Parties arising out of or relating to any injury, loss or damage to person and property that may be sustained as a result of participation in the Activity (“Claims”).

2. I understand that the Activity includes significant dance-related, solo and team-based, athletic movements. I understand that participation in the Activity involves inherent risks, including risk of physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent paralysis and/or death, and I assume all related risks and voluntarily participate in the Activity.

3. I agree to indemnify Releasee against any and all claims, actions, lawsuits, damages and judgments, including attorney’s fees, arising out of or relating to my participation in the Activity.

4. This Release for Participation in Event or Activity (“Release”) shall not be in any way construed as an admission by the Releasee that it has acted wrongfully with respect to me or any other person, that it admits liability or responsibility at any time for any purpose, or that I have any rights whatsoever against the Releasee.

5. This Release shall be binding upon the parties and their respective heirs, administrators, personal representatives, executors, successors and assigns. I have the authority to release the Claims and have not assigned or transferred any Claims to any other party. The provisions of this Release are severable.  If any provision is held to be invalid or unenforceable, it shall not affect the validity or enforceability of any other provision. This Release constitutes the entire agreement between the parties and supersedes any prior oral or written agreements or understandings between the parties concerning the subject matter of this Release. This Release may not be altered, amended or modified, except by a written document signed by both parties. The terms of this Release shall be governed by and construed in accordance with the laws of the State of Florida.

6. I have carefully read and fully understand all the provisions of this Release and am freely, knowingly and voluntarily entering into this Release.

COVID-19 Release For Participation in Event

IIn exchange for participation in Bachata Sensual classes, workshops, teams, and events (the “Activity”), organized by: Anastasia Nikolaeva & Jovanny Fuentes [Name] located at Rhythm & Smooth Event Venue and/or other venues where the Activity may be hosted [Address] (“Releasee”),

 

I hereby agree as follows:

I understand by choosing to participate in the Activity you are waiving Covid-related liability from the Releasee. I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing. I further acknowledge that the Releasee have put in place preventative measures to reduce the spread of the Coronavirus/COVID-19. I further acknowledge that the Releasee can not guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Activity staff, and other event clients. I voluntarily seek services provided by the Releasee and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending the Activity.

I attest that:

1. I am not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.

2. I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19.

3. I have not been diagnosed with Coronavirus/Covid-19 and not yet cleared as non contagious by state or local public health authorities.

    

   I hereby release and agree to hold the Releasee harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the Releasee, or that may otherwise arise in any way in connection with the Activity. I understand that this release discharges the Releasee from any liability or claim that I, my heirs, or any personal representatives may have against the Releasee with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from the Releasee. This liability waiver and release extends to the Releasee together with all owners, partners, and employees.
